Welcome to Motive. By creating an account or using our app or website (collectively, the "Service"), you agree to these Terms. If you don't agree, don't use the Service.
1. Who can use Motive
You must be at least 18 years old, and of legal drinking age (21+) in the United States, to use Motive. You must provide accurate information when creating your account and keep it up to date.
2. Your account
You're responsible for what happens on your account. Keep your password secret. Tell us right away at support@nycmotive.com if you suspect unauthorized use.
3. Community rules
You agree not to use Motive to:
- Harass, threaten, dox, or impersonate anyone.
- Post content that is hateful, sexually explicit, or illegal.
- Promote venues you're not affiliated with or post commercial spam.
- Scrape, reverse engineer, or attempt to disrupt the Service.
- Misrepresent your identity, age, or affiliation.
We may suspend or remove accounts that break these rules, with or without notice.
4. Your content
You keep ownership of the content you post (profile photos, display name, etc.). You grant Motive a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the Service.
5. Venues, events, and third parties
Motive shows information about bars, clubs, lounges, and events in NYC. We don't operate those venues, and we don't guarantee that any venue will be open, safe, or have the cover/availability advertised. Use your judgment. Drink responsibly.
6. Disclaimers
The Service is provided "as is" without warranties of any kind. Motive does not warrant that the Service will be uninterrupted, error-free, or accurate. To the maximum extent permitted by law, we disclaim all implied warranties.
7. Limitation of liability
To the maximum extent permitted by law, Motive and its team are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
8. Termination
You can delete your account anytime by emailing support@nycmotive.com. We may suspend or terminate accounts that violate these Terms, are inactive for long periods, or where required by law.
9. Changes
We may update these Terms from time to time. If the changes are material, we'll notify you in the app or by email before they take effect. Continued use of the Service after changes means you accept the new Terms.
10. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in New York County, New York.
